Can you build a private shelter in Spain?

Spain publishes no permit, obligation or technical standard for private household shelters. Official advice is confinement indoors.

Updated 2026-10-20· 5 official sources

Short answer. Spain publishes no rule on private shelters: no permit, declaration or legal obligation for a household shelter was found in the civil protection law (Law 17/2015) or in national civil protection guidance 12. No Spanish technical standard or approval scheme for civilian shelters was found either 12. Any building work follows ordinary planning rules; ask a structural engineer.

Is a private shelter required in Spain?

No. Spain publishes no legal obligation for households to have a shelter 12. There is no public protective-shelter programme either; see Public shelters in Spain.

Is there a shelter-specific permit?

No shelter-specific permit or declaration was found in Law 17/2015 or in national civil protection guidance 12. That does not mean underground work is free of rules: any building work follows ordinary planning rules. Phaenyx has not reviewed those rules for shelters and does not say whether a given project needs a permit. Ask your town hall (ayuntamiento) before any work.

Is there an official Spanish shelter standard?

No Spanish technical standard or approval scheme for civilian shelters was found 12. There is therefore no official Spanish benchmark to compare a product against. General concepts such as protection factor, shelter ventilation and NBC air filtration are explained in our guides, with their own sources.

What does Spain recommend instead?

The usual official protective measure is confinement: going inside and staying at home or in the building where you are 3. Within 10 km of a nuclear plant, residents are told to stay indoors and follow the plan's instructions 4. In Catalonia's chemical-risk areas, the siren means go inside a building and confine yourself 5. See shelter or evacuate and sheltering in place from a chemical release.

Who should you involve?

Anything underground or load-bearing needs a qualified structural engineer. Phaenyx does not give construction instructions. For background on the risks of buried structures, read What does it take to make a shipping container safe underground? and Can you bury a shipping container?.
