Short answer. Yes. Since 3 July 2025, Latvia's Civil Protection and Disaster Management Law lets any owner voluntarily create a category III shelter following VUGD's minimum-requirements guidelines, or a higher category 1. For building projects submitted after 31 December 2026, shelters become mandatory in certain new buildings 1. Municipalities may co-fund shelters in private buildings 1.
What does the law allow a private owner to do?
Article 7.1 ("Patvertnes") of the Civil Protection and Disaster Management Law, amended on 5 June 2025 and in force since 3 July 2025, states: "Tāda objekta īpašnieks vai valdītājs, uz kuru neattiecas šā panta otrā un trešā daļa, ir tiesīgs izveidot III kategorijas patvertni" (the owner or holder of a building not covered by paragraphs 2 and 3 may create a category III shelter) 1.
- Voluntary category III shelter: created by adapting existing rooms, following VUGD's guidelines on minimum requirements 12.
- Higher category: an owner may also choose to build a category I or II shelter 1.
Do I need a permit?
The law sets no specific shelter permit for a voluntary category III shelter: the owner may create it following VUGD's guidelines 1. Three points still apply:
- New-build shelters must meet the building standard LBN 210-25 3. See shelter standards.
- The Cabinet is to set the procedure for recognising an adapted building as a shelter and for shelter inspections (law, art. 8(2)(8)) 1.
- General building-permit rules for structural works were not checked for these pages. Ask your municipal building authority before any structural work.
Any structural design, ventilation or reinforcement must be done by a qualified engineer. Phaenyx gives no construction instructions.
Where are shelters mandatory?
Building projects not approved or submitted to the building authority before 1 January 2027 must include 1:
| New building | Required shelter |
|---|---|
| Category A and B critical-infrastructure buildings with permanent staff | Category I |
| Apartment buildings with more than five above-ground floors | At least category II |
| Preschools, schools, vocational schools, universities | At least category II |
| Inpatient hospitals | At least category II |
| Other public buildings of at least 2,500 m² | At least category II |
Exemptions. The municipality may exempt the builder if the shelter would cost more than 50% of the building cost, or if existing shelters within 300 m already cover all registered residents and users. One shared shelter may serve several buildings if it is within 300 m of each 1.
What are the owner's obligations?
- Maintain the shelter so people can enter and use it in a disaster, military invasion or war 1.
- Keep the shelter when the building is renovated or its use changes 1.
- Place the shelter sign only on buildings assessed against the minimum requirements that will be publicly accessible during a threat 2.
Who assesses shelters, and can I check my basement?
VUGD assesses state and municipal buildings; private and commercial buildings are assessed by the municipality with the Construction State Control Bureau 4. VUGD publishes an assessment table so private persons can check their own basement 2.
Do I need a private shelter if public shelters exist?
VUGD has assessed 1,665 shelters for more than half a million people 5. Public shelters are meant for people within 300 metres; otherwise VUGD advises sheltering where you are with at least two walls between you and the outside 4. See the public shelters page.
Is there funding?
Municipalities may support the construction, creation or equipment of shelters in private buildings under their own binding regulations 1. Ask your municipality whether such rules exist.
