Can I build a private shelter in Australia?

No Australian law covers fallout or blast shelters. Victoria requires a building permit for a private bushfire bunker; ABCB standard of 2014.

Updated 2026-10-20· 2 official sources

Short answer. Australia has no law on private fallout or blast shelters, and no household is required to have one. The only regulated private shelter is the bushfire shelter, or fire bunker: in Victoria it needs a building permit and must comply with the Victorian Building Regulations 2018 and the National Construction Code performance requirements 1. The national performance standard for private bushfire shelters dates from 2014 2.

Is a shelter required in Australia?

No. There is no obligation to have a shelter anywhere in Australia, and no law covers private fallout or blast shelters.

Which rules apply to a private bushfire bunker?

In Victoria, the Country Fire Authority states: "Bunkers must now comply with Victorian Building Regulations 2018 and National Construction Code performance requirements. A building permit is also required to build a private fire bunker on your property." 1

At national level, the Australian Building Codes Board published the Performance Standard for Private Bushfire Shelters in 2014 2. It is described on our Australia shelter standards page.

The rules in other states and territories were not reviewed here for bushfire bunkers, so Phaenyx does not say whether a permit is needed outside Victoria. Ask your local council before any work.

What about a nuclear or fallout shelter?

No Australian law or standard covers this type of shelter. A project would be ordinary building work, subject to the usual local approvals, which were not reviewed here for shelters. Ask your local council about permits first.

Anything underground or load-bearing is structural work and needs a qualified structural engineer, not a generic plan. Our guides on burying a shipping container and what it takes to make a container safe underground explain why. The concepts behind shelter performance are covered in protection factor, shelter ventilation and NBC air filtration.

What does official advice focus on instead?

Australian guidance is built around natural hazards: a kit for at least three days at home, warnings through Emergency Alert and AusAlert, and last-resort places for cyclones and bushfires. See Australia emergency supplies, alerts and public shelters.
